Acceptance of These Terms

By accessing or using HomeDeck.net (the "Service"), creating an account, or clicking “I agree” at registration, you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you must not use the Service.

These Terms form a legally binding agreement between you ("User," "you," "your") and HomeDeck ("HomeDeck," "we," "us," "our"). By using the Service you represent that you are at least 18 years old and have the legal capacity to enter into binding contracts.

Educational Purpose — Not Professional Advice

The calculations and scores provided by HomeDeck are based on general models, publicly available data (FRED, FHFA, IRS, BLS), and user-supplied inputs. They do not account for every factor relevant to your unique situation and may not reflect current market conditions, local regulations, or your personal creditworthiness.

You must not rely on HomeDeck outputs as the sole basis for any financial, legal, or real-estate decision. Before purchasing, financing, or committing to any real property, you should independently verify all information and consult licensed professionals including, but not limited to, a licensed mortgage lender or broker, a licensed real-estate agent, a certified public accountant (CPA), and/or a real-estate attorney.

• HomeDeck is not a licensed real-estate broker or agent.
• HomeDeck is not a registered investment advisor, financial planner, or financial advisor.
• HomeDeck is not a law firm and does not provide legal services.
• HomeDeck is not a tax advisor and does not provide tax services.

Description of the Service

HomeDeck offers a subscription-based web application that provides home affordability calculators, buy-vs-rent analysis tools, property search functionality powered by third-party data providers, an AI-powered Q&A coach, and related educational features (collectively, the "Features").

Access to Features is contingent on maintaining an active, paid subscription plan ("Pack") unless otherwise stated. The specific Features available in each Pack are described on the /pricing page and may be updated from time to time with reasonable notice.

Subscriptions, Billing, and Cancellations

Subscription. Paid plans are billed in advance on a monthly or annual basis. Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date.

What you are paying for. A subscription grants you access to the Features described in your chosen Pack during the subscription period. You are purchasing access to software tools — not professional advice, not property listings, not guaranteed outcomes, and not any form of brokerage or advisory service.

Cancellations. You may cancel your subscription at any time through your Account settings or the Stripe customer portal. Cancellations take effect at the end of your current billing period. You will retain full access to your Pack Features until that date. No partial refunds are issued for unused time within a billing period.

Refund Policy. All subscription fees are non-refundable except where required by applicable law. If you believe you were charged in error, contact us at support@homedeck.net within 7 days of the charge and we will review your case. We do not offer money-back guarantees or trial periods.

Price changes. We reserve the right to change subscription prices with at least 30 days' written notice (email). Continued use after a price change takes effect constitutes acceptance of the new price.

Limitation of Liability

In no event shall HomeDeck's total cumulative liability to you for all claims arising out of or relating to these Terms or the Service exceed the greater of (a) the total subscription fees you paid to HomeDeck in the 3 months immediately preceding the claim, or (b) US $50.

You expressly acknowledge that HomeDeck is not liable for: any home purchase or refinance decision you make; any financial loss arising from acting on HomeDeck estimates; any inaccuracies in third-party data used within the Service; or any failure, interruption, or unavailability of the Service.

No Warranties

The Service is provided “AS IS” and “AS AVAILABLE” without warranty of any kind, express or implied. HomeDeck expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that: (a) the Service will be uninterrupted, error-free, or secure; (b) any data, rates, or calculations provided will be accurate, complete, or current; (c) results obtained from use of the Service will meet your expectations; or (d) defects in the Service will be corrected.

Market data, mortgage rates, property tax rates, appreciation estimates, and all other third-party data are sourced from publicly available providers and may be delayed, incomplete, or out of date. HomeDeck makes no representation as to the accuracy of such data.

Indemnification

You agree to indemnify, defend, and hold harmless HomeDeck and its owners, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any decision you make in reliance on any output, estimate, or recommendation from the Service.

Dispute Resolution and Binding Arbitration

Informal resolution first. Before initiating any formal proceeding, you agree to contact us at support@homedeck.net and attempt to resolve the dispute informally for at least 30 days.

Binding arbitration. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. Arbitration will be conducted in English on an individual basis.

No class actions. You waive the right to participate in any class action lawsuit or class-wide arbitration. All claims must be brought individually.

Governing law. These Terms shall be governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Any claims not subject to arbitration shall be brought exclusively in the state or federal courts located in Travis County, Texas.

Exception. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulation.
• Attempt to reverse-engineer, scrape, or extract data from the Service in bulk.
• Use automated tools (bots, scrapers) to access the Service without prior written consent.
• Resell, sublicense, or redistribute access to the Service or its outputs commercially.
• Submit false, misleading, or fraudulent information to the Service.
• Circumvent usage limits, rate limits, or subscription tier restrictions.
• Interfere with or disrupt the integrity or performance of the Service.

Intellectual Property

All content, design, code, algorithms, branding, and materials on HomeDeck.net are the exclusive property of HomeDeck or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right or license to HomeDeck's intellectual property except the limited right to use the Service as described herein.

Outputs generated by the Service based on your inputs (e.g., your specific affordability verdict) may be used by you for personal, non-commercial purposes. You may not republish, resell, or distribute Service outputs without our written permission.

Privacy

Your use of the Service is subject to our Privacy Policy, incorporated herein by reference. We collect, use, and protect your personal and financial data as described therein. We do not sell your personal data or financial information to third parties, lenders, real-estate agents, or advertisers.

Third-Party Data and Services

The Service incorporates data from third-party sources including but not limited to the Federal Reserve (FRED), Federal Housing Finance Agency (FHFA), U.S. Bureau of Labor Statistics (BLS), Internal Revenue Service (IRS), RentCast, and Stripe. HomeDeck does not endorse these sources and is not responsible for the accuracy, availability, or timeliness of third-party data.

Payment processing is handled by Stripe, Inc. HomeDeck does not store your payment card information. Stripe's use of your information is governed by Stripe's privacy policy.

Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or applicable law. Upon termination, your right to use the Service ceases immediately. Sections 2, 5, 6, 7, 8, and 10 survive termination.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Effective date” at the top of this page and, for material changes, notify you by email or by a notice within the Service. Your continued use of the Service after any change constitutes your acceptance of the updated Terms.
